Patent Filing Process in India

A comprehensive step-by-step guide to the patent registration process

Patentability Search

A search is conducted to determine if the potential invention is patentable based on any available published prior art.

Provisional Specification Drafting

If there is no knowledge about the product in the prior art, the patent specification is drafted to obtain a priority date.

Provisional Specification Filing

After the patent is properly drafted, it is filed with the Patent Office. Filing can be done manually or electronically.

Final Patent Drafting

The inventor explains to the public the best manner in which the invention can be exploited by others, including detailed claims.

Final Specification Filing

Within twelve months of the filing date of provisional specification, final specification must be filed with the relevant authority.

Patent Examination

The Patent Examiner examines the patent and raises objections which can be addressed by the inventor with professional help.

Patent Publication

After examination, the specifications will be published in the journal only after 18 months from the date of filing.

Patent Grant

If all objections are overcome and there are no third party objections, the Patent Office will grant the patent.
